These Terms of Service (“Terms”) govern your access to and use of the Libatious mobile application, website, and related services (collectively, the “Service”), operated by Libatious Corporation — a U.S.-based company incorporated in the State of Delaware — (“Libatious,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

You must be at least 21 years of age to use Libatious. By using the Service, you confirm that you meet the legal drinking age in your jurisdiction. You may not use the Service if you are prohibited from doing so under applicable laws.

To access certain features of the Service, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information;
• Maintain the confidentiality of your login credentials;
• Be fully responsible for all activities that occur under your account.

By using the Service, you agree not to:

• Use the Service for unlawful, harmful, or abusive purposes;
• Submit false, misleading, offensive, or harmful content;
• Attempt to access systems or accounts that do not belong to you;
• Copy, reverse-engineer, or redistribute any part of the Service without prior written consent.

Libatious provides cocktail recommendations based on user input and preferences. These recommendations are intended solely for informational and entertainment purposes. We do not promote or encourage excessive or irresponsible alcohol consumption.

Please drink responsibly and comply with local laws regarding alcohol use and consumption.

You may submit content to the Service, such as ratings, feedback, preferences, and other inputs.

By submitting content, you grant Libatious a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and modify your content in connection with operating and marketing the Service.

All content and intellectual property on the Service, including trademarks, logos, graphics, designs, source code, and data, are the property of Libatious Corporation or its licensors. You may not use, copy, distribute, or create derivative works based on any part of the Service without prior written consent.

The Service may include links to or integrations with third-party services (e.g., Apple, Google, Meta, or analytics providers). We are not responsible for the content, policies, or practices of any third-party services.

The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee:

• The accuracy or relevance of cocktail recommendations;
• Uninterrupted or error-free access to the Service;
• That the Service will meet your expectations or be secure.

To the fullest extent permitted by law, we disclaim all warranties, express or implied.

To the maximum extent permitted by law, Libatious and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including loss of data or profits.

You agree to indemnify, defend, and hold harmless Libatious, its officers, directors, employees, and partners from any claims, damages, liabilities, or expenses arising from:

• Your use or misuse of the Service;
• Your violation of these Terms;
• Your violation of any applicable laws or third-party rights.

We reserve the right to suspend or terminate your account or access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful.

You may also delete your account at any time via the in-app account settings. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware.

We may update or modify these Terms from time to time. If we make material changes, we will notify you via the app, email, or website. Continued use of the Service after such changes constitutes your acceptance of the updated Terms.
